Rules and Regulations

LOT SALES/OWNERSHIP

All lots in the Lake View Cemetery are sold in accordance with the provisions of the laws of the State of New York.

The full purchase price must be paid before a deed will be given or burial allowed on the lot. Lots sold after 10/1/2015 shall have no more than 1 full-body burial, plus 2 cremations or 4cremations, for a lot measuring 3’6″ x 10′. Lots sold for Cremation only, measuring 4′ x is 3′ shall have no more than 2 cremation burials. Except as provided for in Section 1513(c) of the Not-for-profit Corporation Law, no lot owner may transfer his or her lot.

BURIALS

No interment shall be allowed without permission being first obtained from Lake View Cemetery Company, Inc.

Concrete vaults or concrete grave liners shall be required for full body interments in all graves after January 1st. 1985, in accordance with the provisions of the Cemetery  Board Directive 201.6.

Human or pet cremated remains will not be permitted to be scattered in any part of the cemetery.

Interments in a lot are restricted to those entitled to burial therein according to the terms of Section 1512 of the Not-for-profit Corporation Law. Permission for the burial of those not entitled to burial according to the said section must be filed with Lake View Cemetery Company, Inc. by the lot owner(s).

Interments on Sundays and Holidays will be governed by Cemetery Board Directives  201.8 and  201.12.

Burials in severe weather conditions or similar conditions will be performed in compliance with NYCRR 1510(b) and additional charges may apply in compliance with NYCRR 1509(d). If necessary, arrangements for holding the body during this time should be arranged by the Funeral Director.

Disinterment’s will be allowed provided there is compliance with all the provisions of Section1510(e) of the Not-for-profit Corporation Law.

No vault or mausoleum shall be built.

No bronze veteran’s markers shall be placed on a lot without the use of a concrete base.

Glass blocks or glass vases are prohibited.

MONUMENTS/MARKERS/EMBELLISHMENTS

The Lake View Cemetery Company, Inc. reserves the right to remove, after due notice to the lot owner, any embellishment on the lot, effigy, or inscription which, in the opinion of the majority of the Board of Directors, is unsightly or dangerous.

Monuments are restricted in size to dimensions which will not cover more than 25% of the surface area of the lot.

The base of all monuments shall be finished true and level so as to fit on foundations without wedging or sprawls.

No monument will be allowed to be delivered to the cemetery until the foundation is installed and ready to receive the monument.

Heavy trucking or vehicular traffic shall be refused entrance to the cemetery when, in the opinion of the Board of Directors, injury to roads, driveways might result.

All monuments and markers must be constructed of granite, marble, or bronze only.

FLOWERS AND PLANTINGS

The Lake View Cemetery Company, Inc. reserves the right to remove all flowers, wreaths, containers, or other decorations from lots as soon as they become unsightly. No shrubs or trees are allowed. Containers shall be placed so that they are next to the stone or marker, left or right side.

VISITATION

All persons shall be allowed for visitation access to the cemetery during daylight hours, observing the posted rules which are in effect and the propriety due the cemetery.

USE OF ROADS AS A DRIVE-THROUGH

Lake View Cemetery is private property. Therefore, roads may not be used as a drive-through as per signage. The main road has been designated as a walking route for children en route to Ithaca High School.

These rules and regulations may be amended by the Board of Directors of said Lake View Cemetery Company, Inc., but no such amendments shall be effective until approved by the New York State Cemetery Board.
